Ticky Terms of Service

Please read these Terms before using Ticky. They are designed to explain the rules for using Ticky’s Discord bot, web dashboard, ticketing tools, public transcript pages, optional AI-assisted features, integrations, and payment features.

1. Acceptance of Terms
These Terms govern access to and use of Ticky’s Discord bot, web dashboard, ticketing features, public transcript pages, AI-assisted features, integrations, and payment features.
2. The Service
Ticky is a Discord support-ticket bot and authenticated dashboard. It lets Discord servers create and manage tickets, configure staff and workflows, retain transcripts, create knowledge-base content, use optional AI-assisted support, and use certain optional integrations.
3. Server Administrators and Permissions
A person who installs, configures, pays for, or administers Ticky for a Discord server represents that they have authority to do so for that server. Dashboard administration is restricted to authenticated Discord users who currently have the relevant server-management permissions. Administrators are responsible for configuring staff access, roles, transcript delivery, AI settings, integrations, and the handling of their community’s data.
4. Customer Content and Server Data
“Customer Content” means content a server or its users submit or make available through Ticky, including ticket messages, attachments, knowledge-base content, settings, and integration data. The server or applicable user remains responsible for Customer Content and for obtaining any notices, permissions, or consents required to use Ticky in its Discord community. Ticky receives only the limited right necessary to host, process, secure, display, transmit, and operate Ticky and its selected features; it does not claim ownership of Customer Content.
5. Public Transcript Links — Important Notice
Each ticket may have a unique public transcript link. Anyone who possesses that link can access the transcript and its associated content, which may include message text, participant display names and avatars, timestamps, and attachments. Transcript links may be posted in a server’s configured transcript-log channel or sent to the ticket opener. Administrators are responsible for deciding whether and how to share these links.
6. AI-Assisted Features
When enabled for a server, Ticky may use configured third-party AI services to process relevant ticket conversation context, knowledge-base content, ticket-routing or classification context, summaries, and, where applicable, qualifying image attachments. AI output may be inaccurate, incomplete, or unsuitable for a particular purpose and should be reviewed by a human before relying on it. Ticky’s AI functionality does not itself issue refunds, modify accounts, fulfill orders, or make binding commitments on behalf of a server.
7. Optional Third-Party Integrations
Ticky integrates with Discord and may offer optional third-party features, inlcuding but not limited to SellAuth for a server’s read-only order or invoice lookup, and NOWPayments for an optional crypto checkout. SellAuth lookup is read-only: Ticky does not ship, deliver, refund, or alter a customer order through that integration. Third-party services are governed by their own terms and privacy practices.
8. Plans and Payments
Ticky offers FREE, PRO, BUSINESS, and ENTERPRISE plan tiers. Discord-native paid subscriptions, where offered, are managed through Discord’s subscription tools. Optional NOWPayments crypto purchases are one-time, one-month purchases and do not automatically renew. Promotional, referral, and redemption access may be granted under the terms presented with those offers. Enterprise access is arranged separately.
9. Data Deletion and Account Changes
Removing Ticky from a Discord server does not automatically delete Ticky-held server data. An authorized server administrator may use the Dashboard’s Settings → Danger Zone to permanently delete the server’s Ticky data, subject to the Privacy Policy. This process does not delete Discord-controlled channels, messages, roles, or other Discord-held data, and some payment or accounting records may be retained where necessary.
10. Acceptable Use
You may not use Ticky to violate law, Discord’s terms, third-party rights, privacy rights, or intellectual-property rights; harm others; or attempt unauthorized access to the service. You may not bypass access controls, abuse public transcript links, upload malware, interfere with service operation, or use the service fraudulently.
11. Availability and Changes
Features, integrations, limits, and plans may change from time to time.
12. Disclaimers, Limitation of Liability, Indemnity, and Disputes
12.1 Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT: (A) AI-GENERATED ANSWERS WILL BE ACCURATE, COMPLETE, OR APPROPRIATE FOR YOUR SERVER; (B) ESCALATION, CRISIS-DETECTION, OR PROMPT-INJECTION GUARDRAILS WILL CATCH EVERY SITUATION THEY ARE INTENDED TO CATCH; (C) THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; OR (D) ANY DATA WILL BE TRANSMITTED, STORED, OR RETAINED WITHOUT LOSS. YOU ARE SOLELY RESPONSIBLE FOR REVIEWING YOUR KNOWLEDGE BASE, SUPERVISING HOW TICKY IS USED ON YOUR SERVER, AND FOR ANY DECISION MADE IN RELIANCE ON A TICKY RESPONSE. NOTHING IN THE SERVICES CONSTITUTES LEGAL, MEDICAL, FINANCIAL, OR OTHER PROFESSIONAL ADVICE.
Some jurisdictions don’t allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
12.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL TICKY, ITS OPERATOR, OR THEIR RESPECTIVE OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, OR DATA, ARISING FROM OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) FIFTY U.S. DOLLARS ($50).
THESE LIMITATIONS APPLY REGARDLESS OF THE LEGAL THEORY ON WHICH A CLAIM IS BASED — CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE — AND EVEN IF A REMEDY FAILS ITS ESSENTIAL PURPOSE. SOME JURISDICTIONS DON’T ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
12.3 Indemnity
You agree to defend, indemnify, and hold harmless Ticky, its operator, and their respective officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) Your Content; (b) your Server’s or your Server members’ use of the Services in violation of these Terms or applicable law; (c) any Discord application or bot token you connect via the white-label feature (§4), including any claim that your use of that token violated Discord’s own Terms of Service; or (d) your violation of any third party’s rights, including intellectual property, privacy, or publicity rights. We reserve the right, at our own expense, to assume exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with our defense.
12.4 Dispute Resolution; Governing Law
Informal resolution first. Before filing a claim, you agree to contact us at hey@heyticky.com and give us 30 days to resolve the dispute informally. Most concerns can be resolved this way. Governing law. These Terms, and any dispute arising from or relating to them or the Services, are governed by the laws of the local county the founder resides in, without regard to its conflict-of-laws principles.
